Rustling Oaks expansion to be done in two phases

Marion P& Z heard a request from the developer of Rustling Oaks subdivision to change an earlier request for 12 additional homes in to two separate phases.

The commission at its June meeting had approved a 12 lot preliminary plat and agreed with the new plan for four lots as a Phase 3 and eight lots for a Phase 4 build out.

“Four of the lots are along McNeely Road and would be accessed by McNeely Road,” Cain said. “So there would be no street requirements for that. On the other eight lots, there is a street extension that has to be built.”

Cain said the city prohibits lots from being sold in a subdivision until all of the public improvements are made and accepted by the city.

“He has to install some water and sewer extensions to serve those four lots, but since they are accessed off McNeely Road there is no street to be built. So we agreed to break that down into Phase 3 which is the four lots, and Phase 4 which is the eight remaining lots.”
